Transfer of foreigners’ work units
Foreigners with valid work permits/employment permits and residence visas who change their work units while working in China should go through the change procedures in a timely manner: handle resignation and cancellation in the original unit, and then apply for work permits and residence permits in the new employer. They can only work in the new unit after obtaining them, otherwise they are suspected of illegal employment. The processing time for change procedures is about 3 weeks, so it is necessary to apply in advance. It is recommended to start applying 2 months in advance.
In addition, if there are significant changes in the industry and position, the probability of rejection of work permit applications will be high.
Application requirements
1. Age range: generally between 21 and 60 years old. For individuals aged 60 and above who are over the age limit, please consult us

3. Have a definite work unit in Shanghai and have the qualification to employ foreigners
4. Generally, at least a bachelor’s degree or equivalent education is required. For those who do not have sufficient education, please consult us

Application process
1. Cancel the existing work permit.
If the contract is terminated in advance or the employment relationship is terminated, the employer shall apply for cancellation to the decision-making institution within 10 working days from the date of the event. If the employer is terminated, the applicant may apply to the decision-making authority for the cancellation of the work permit.
2. Submit a new work permit application.
After canceling the original work permit, submit a new work permit application within 30 days from the date of cancellation.
(1) Online application process
After entering the system, click the “Domestic Application for Foreigner’s Work Permit in China” on the left to start filling in and uploading the attachment materials

③ Applicant’s passport or international travel document
④ Visa or valid residence permit
⑤ Foreigner Work Permit
⑥ Certificate of cancellation of original work permit.
After filling out the form, submit the application, and the result usually takes 5 working days.
(2) Precautions
① Apply at least 30 days before the expiration of the original residence permit.
② Those who change to a new post (occupation) must apply for a new work permit for foreigners in China.
③ For those who are transferred to foreign high-end talents (Class A), corresponding proof materials must be submitted.
④ All original paper materials and Chinese translations must be uploaded electronically to the processing system.
⑤ Education background, certificate of no criminal record, physical examination, etc. do not need to be resubmitted.
⑥ If the new company has not recruited foreigners, it needs to go through the system registration of the Foreign Affairs Bureau and the filing of foreign-related enterprises.
⑦ The new job position needs to be consistent with the original job position.
⑧ Need to obtain a resignation certificate from the original company.
3. Update residence permit
Important reminder:
If there is a change in job function, it is necessary to apply for a work permit notification and cannot be changed directly.

2. Employment contracts with employees and several materials stamped with official seals (generated after online declaration of departmental information)

Notes on Changes
01. For those who are transferred to new positions within the same unit, including those who are promoted from professional positions to administrative management positions, a change application letter and corresponding supporting materials should be provided. If there are other provisions in national laws and regulations, they shall be followed.
02. In case of changing to a new post (occupation), the existing work permit shall be cancelled and the foreigner’s work permit to China shall be applied for again.
