Article 41 of the Law of the People’s Republic of China on the Administration of Exit and Entry stipulates that foreigners who work in China shall obtain work permits and work type residence certificates in accordance with regulations. No unit or individual may employ foreigners who have not obtained work permits and work type residence certificates. Holding a work permit or work visa is considered legal employment. Obtaining other visas (Q family visit visa, L tourist visa, M trade visa, study permit, personal affairs permit) for work is considered illegal employment and will be subject to severe national punishment. Therefore, it is necessary to confirm the type of visa obtained before starting work.

Classification of work permits for foreigners

A-class foreign high-end talents

Foreign high-end talents refer to scientists, technology leaders, international entrepreneurs, specialized and special talents who meet the needs of China’s economic and social development based on the “high-precision and cutting-edge shortage” and market demand orientation, as well as talents who meet the standards for foreign high-end talents with points and credits. B-class foreign professional talents

Foreign professionals refer to those who meet the requirements of the foreign work guidance catalogue and positions in China, are urgently needed for economic and social development, have a bachelor’s degree or above and 2 years or more of relevant work experience, and are not more than 60 years old; For those who have a genuine need, meet the standards for innovative and entrepreneurial talents, professional skilled talents, outstanding foreign graduates, foreign professional talents who meet the points based standards, and those who comply with intergovernmental agreements or protocols, age, educational background, or work experience restrictions may be appropriately relaxed. Other foreign personnel in Class C

Other foreign personnel refer to other foreign personnel who meet the needs of the domestic labor market and comply with national policies and regulations.

Application Materials (New)

1. Foreign nationals’ passports: holding passports or other international travel documents

2. Proof of work experience: a certificate or recommendation letter issued by the applicant’s original employer

3. Educational certificate: Certified highest degree (educational background) certificate or relevant approval document, professional qualification certificate

4. Certificate of No Criminal Record: A certified certificate of no criminal record issued by the official of the applicant’s country of nationality or long-term residence (region)

5. Employment contract: a labor contract signed between foreign nationals and domestic enterprises

6. Enterprise Information: Business License or Registration Certificate of Employer or Relevant Institution

7. Enterprise Tax Payment Certificate: The employer or relevant organization has issued a tax payment certificate for the previous year

8. Other handling documents: health certificates, temporary accommodation registration in China, recent photos, passports or other international travel documents of foreigners to be employed;

If there are accompanying family members, they need to provide their passports, marriage certificates, or birth certificates, which have been authenticated by the Chinese embassy or consulate.
